Terms of Hire

The NSM Fire jukebox and 2 extension speakers (the Hire Items) are supplied to the above mentioned Customer on these conditions:

1. The Hire Items shall at all times remain the sole property of Creative Occasions Ltd.

2. The Customer shall not sell, encumber or part with possession or control of the Hire Items.

3. The Customer is responsible for the safe custody and good condition of the Hire Items from the time of installation until the time of removal.

4. The Customer shall not alter, tamper with, repair or attempt to repair the Hire Items in any way, nor permit any other person to do so unless authorised by Creative Occasions Ltd.

5. Any damage to or loss of the Hire Items will be charged at replacement value.

6. A booking deposit of 50% will apply as confirmation of this Hire Agreement.

7. Unless otherwise agreed by arrangement, the balance of the full hire fee payable must be paid prior to taking receipt of the Hire Items.

8. Creative Occasions Ltd reserve the right to charge a call-out fee for delivery and/or collection of the Hire Items outside of normal working hours.

9. In the event of a cancellation, cancellation fees may be charged. If the cancellation occurs within 8 - 14 days of the booking date, a fee of 20% may be charged; within 2 – 7 days of the booking date, a fee of 50% may be charged and within 24 hours of the booking date, a fee of 100% may be charged.

10. Penalty charges of 10% or the full amount of any hire(s) unable to be honoured, whichever is greater, will be payable if the Hire Items are not able, for reasons attributable to The Customer, to be picked up at the agreed time.

11. Any mutually agreed departure from these conditions is to be noted on this agreement and signed by both parties.

12. The Customer shall be responsible for and indemnify Creative Occasions Ltd. against all costs, losses, claims or damages brought against or suffered by Creative Occasions Ltd. arising directly or indirectly out of any act or default of The Customer in respect of the Hire Items or in relation to any breach of these clauses. Furthermore, The Customer will indemnify Creative Occasions Ltd. against any claim made against Creative Occasions Ltd. by a third person in respect of injury arising out of the use of the Hire Items.

13. The person signing the document for and on behalf of The Customer, if not personally The Customer, warrants that he/she has the authority of The Customer to make this contract on The Customer’s behalf and that he/she is empowered by The Customer to bind The Customer to this agreement. The person so signing hereby indemnifies Creative Occasions Ltd. against all losses and costs that may be incurred by Creative Occasions Ltd arising out of the person so signing the agreement failing to have such power or authority.
